Mark was brought in by FMH Ltd to appeal a refusal of planning permission for two contemporary dwellings in a back-land location in Warminster. The application had been refused on the grounds that it would fail to respect the character of the area and that it would have an overbearing impact on a neighbour. This refusal followed a previously dismissed planning appeal for development of the site.
Through the appeal Mark was able to show that the refusal grounds were flawed and that no full assessment of the character of the area had been undertaken. The appeal was allowed and the client was able to regain their costs incurred through the appeal because a full award of costs was made against the Council.
