Planning enforcement advice and appeals
Mark was a Team Leader for the Enforcement Team during part of his time at Bath and North East Somerset Council. He has a good understanding of the planning enforcement process and can assist if you have been approached by a Local Planning Authority Enforcement Team or you have been served with an enforcement notice, breach of condition notice, temporary stop notice or a planning contravention notice.
We can advise on the best approach to resolve enforcement issues be this through a submission of a retrospective planning application or lodging an appeal against enforcement action. We will look at the planning merits of your case but we will also look at the technical side of the process to ensure due process has been followed and a notice has been served correctly and that the development actually requires planning permission either because of the nature of the development itself or the length of time it has been in place or occurring if it relates to a change of use.
Planning Enforcement is an extremely technical area of planning and failure to address formal enforcement action can ultimately lead to criminal charges being brought against a landowner so it is vitally important to seek expert advice from the outset to resolve enforcement complaints.
